Immigrant Investor Program

The EB-5 Immigrant Investor Program offers two primary pathways for investment, each with its
own set of conditions and requirements:

Direct Investment

  • Minimum Investment of USD 800,000 if investing directly into a new commercial enterprise in a Targeted Employment Area (TEA) - a rural area or area with high unemployment.
  • Minimum Investment of USD 1,050,000 if investing in a commercial enterprise or project located outside of the TEA, in a high employment area.
  • The investment must result in the creation of at least 10 full-time jobs for qualifying U.S. workers within two years of the investor's admission to the U.S. as a Conditional Permanent Resident.
  • The investor is required to have an active role in the management of the new business. This could be through day-to-day managerial control or through policy formulation. The investment can be made in various business sectors, such as manufacturing, retail, service, or others.

Regional Center Investment

  • Just like the direct investment option, the investor needs to invest a minimum of USD 800,000 if the investment is in a TEA, or USD 1,050,000 if outside of the TEA.
  • However, the investment is made into a project managed by an USCIS-approved Regional Center.
  • The investment still needs to create or preserve at least 10 full-time jobs. Although, the job creation can be direct or indirect, meaning it can include jobs created collaterally or because of capital invested in a commercial enterprise affiliated with a Regional Center.
  • The investor's role in a Regional Center investment is typically more passive. While they may have limited say in the day-to-day management or policy formulation, the Regional Center will handle these aspects.
  • Regional Centers offer a range of investment projects spanning various sectors, such as real estate, energy, infrastructure, agriculture, and more.

In both investment routes, the investment capital must be at risk throughout the investment period, meaning it cannot be guaranteed a return or
redemption. The investor also needs to demonstrate that the invested funds were obtained lawfully.
